Terms of purchase of tickets in the ticket distribution system Karabas.ch

1. GENERAL RULES

These Terms apply to the sale of tickets and goods in the Karabas.ch system, however, the provisions of the organizers (hereinafter referred to as the "Organizers' Regulations") of individual artistic events (including performances, concerts and other events) or direct sellers (hereinafter referred to as the "Organizers") may impose additional obligations on buyers that are not specified in these Terms. Each Client, no later than the moment of expressing the intention to conclude a contract for the sale of tickets with Karabas.ch and a contract for participation in the event with the Organizer (in both cases concluded remotely), has the opportunity to familiarize themselves with these Terms and accept them, as well as the Organizer's Rules, and is notified of their rights and obligations.

By making a transaction on the Karabas.ch website, the Client may conclude a contract for the sale of tickets and an additional contract for the sale of goods. Tickets and products are sold through the karabas.ch system by the company: SWISSTIX SARL (Société à responsabilité limitée),IDE\UID CHE-109.854.598, c/o FID-ELITE SA, Place du Tunnel 9, 1005 Lausanne, Suisse, e-mail: [email protected].

The information about the Organizer for each event is provided in the description of the event on the website www.karabas.ch. Unless otherwise stated on the website, the Organizer is an entrepreneur and the organization of the event falls within the scope of its activities.

Karabas.ch is authorized to act on behalf of the Organizer in connection with the conclusion and execution of the contract for participation in the event between the Client and the Organizer.

2. CONTRACT AND PURCHASE PROCEDURE

Tickets are sold on the Karabas.ch website. Tickets can also be purchased through our partners. Tickets purchased at a point of sale are considered sold from the moment of payment to the operator of the stationary point of sale.

When ordering and paying for tickets, the Client is obliged to exercise due diligence. Entering incorrect information, such as the transfer amount, booking number, payment code or payer details that prevent the Client from being identified, may result in payment being refused and the transaction being cancelled.

When purchasing tickets by the Client, Karabas.ch acts as an intermediary between the Event Organizer and the Client. Karabas.com is responsible for delivering the ticket to the event. The Organizer is obliged to ensure that the ticket holder is able to participate in the event.

2.1. Buying tickets on the Karabas.ch website

Having selected an event on the website, the category and type of tickets, and having designated the seats on the plan of the hall where the selected event will take place (for events with numbered seats) or having indicated the number of seats/unnumbered packages (for events with unnumbered seats), fill out the form, indicating your personal data, and also selecting the method of payment and delivery of tickets.

When you have chosen to pay by card or online transfer through the payment system, by clicking the "Confirm and pay" button, you agree to the terms of the distance agreement and book a ticket for the event you have selected. Clicking the "Confirm and pay" button places an order with an obligation to pay and is a confirmation of the purchase on the www.karabas.ch website. After that, the Client is redirected to the website of the payment system. After Karabas.ch receives information from the payment system about the Client's payment, a confirmation of the ticket booking is sent to the e-mail address specified by the Client during the booking, and in the case of choosing a home delivery ticket - an electronic ticket sent by e-mail as a link or attachment.

When paying for a ticket by online transfer or card through the payment system, the Client is sent a confirmation of payment registration by e-mail.

Your booking in the Karabas.ch system is processed after Karabas.ch receives confirmation of the Client's payment from the payment system.

The use of bots or other automated IT tools that allow you to purchase tickets without the participation of the Client is prohibited. We reserve the right to cancel tickets purchased using unauthorized tools.

3. TICKETS

3.1. General Provisions

A ticket is a document entitling you to participate in the event for which it was issued. By purchasing a ticket you agree to the Terms and Conditions of Participation in the event. A single ticket entitles one person to enter. Depending on the type of event, a ticket may be personalized or bearer. A personalized ticket entitles only the person whose name and surname are indicated on the ticket to enter. The admissibility and procedure for changing personal data in a ticket, including the cost and its amount, are determined by the Organizer in its Terms and Conditions.

Tickets must be checked upon entry to the event. Reuse is not permitted. It is prohibited to photocopy, scan or copy tickets in any other way. If such actions are detected, the ticket becomes invalid.

Visitors should keep their tickets in a safe place. Karabas.ch is not responsible for lost or stolen tickets. Please note that direct sunlight or heat may damage tickets.

Duplicate tickets are issued only with the permission of the Event Organizer. A fee (plus shipping costs) may be charged for issuing duplicates.

Visitors have the right to check that the ticket matches the contents of their order. If the ticket contents do not match the order, the Customer is obliged to notify Karabas.ch immediately, as errors in the ticket contents may result in denial of entry to the event. Damaged tickets may result in the code not being verified and, as a result, denial of entry to the event.

The ticket entitles the holder to participate in the event at the seat indicated on the ticket. In justified cases, in particular for technical or operational reasons, Karabas.ch and the Organizer reserve the right to replace the originally ordered seats with others both before and during the event. Karabas.ch reserves the right to set limits on the number of tickets for certain events per person. This number is determined by the Organizer and is checked for each transaction. This policy is aimed at preventing unfair ticket purchasing practices. The maximum number of tickets may be limited per person or per payment card. This limitation cannot be circumvented by creating additional accounts by the same Customer. We reserve the right to cancel tickets purchased in excess of this limit. Tickets may be sold with certain restrictions on entry or use, such as limited, obstructed or side views, or a minimum age for entry. Any such restrictions will be posted on our website or otherwise notified prior to or at the time of booking.

The purchase of tickets for artistic, entertainment or sporting events for the purpose of resale for profit or their sale for profit is illegal and constitutes an offence. In addition, the Organisers may prohibit the resale or transfer of tickets for individual events. Tickets may not be combined with hotel services, travel or accommodation services and/or any other goods, products or services to create a package without the express written consent of karabas.ch or the Organiser.

Decisions on event cancellation, refunds due to event cancellation, ticket exchanges, refusal of entry to the event, requests to leave the event, changes to the event programme or the seat of the ticket holder are made by the Organiser in accordance with the conditions set out in the event regulations.

3.2. Prices and price categories

Depending on the event, tickets are available in different price categories in the sales system. Some events also offer discounts and special packages, such as "3+1" (i.e. buy four tickets for the price of three). Such tickets are provided for a specific event at the discretion of the event organizer.

The prices of tickets for the event are determined by the Organizer. Karabas.ch acts only as an intermediary in their sale. The Organizer determines the distribution of seats by price categories.

The map with the site plan posted on the Karabas.ch website is for illustrative purposes only. Detailed information on the conditions on the site, including visibility from individual seats, is provided by the Organizer. In case of doubt, the Client should contact the Organizer for information. Karabas.ch does not have such information and, therefore, is not responsible for any inconvenience caused to the Client due to the specific features of the seat chosen by the Client.

If the complaint is lodged due to inconvenience (e.g. poor visibility due to the location of television cameras), Karabas.ch may mediate the complaint process for some events. However, Karabas.ch only acts as an intermediary and the Event Organizer is responsible for handling the complaint. During the ticket sales period, the ticket pool may be increased (additional tickets may be added to the sales system) or decreased. Ticket prices may change during the sales period. Therefore, if a ticket reservation made through the Karabas.ch sales system is cancelled, e.g. because the Client paid for the tickets after the deadline or the electronic payment system did not confirm the payment for the Tickets on time, Karabas.ch shall not be liable to the Client for the impossibility of purchasing tickets at the originally selected price (especially if the price of tickets for a specific event has increased in the meantime or only more expensive tickets are available on Karabas.ch).

Karabas.ch strives to ensure that the ticket prices available to our Clients correspond to the prices of the Organizer. However, since Karabas.ch bears the costs of operating the electronic ticket booking system, the ticket prices on the Karabas.ch website and at its points of sale may be higher than those of the Organizer. These additional fees are intended to cover the costs of operating the website. Refusal to pay an additional fee to the original ticket price of the Organizer, expressed after payment for the reservation, does not constitute grounds for filing a complaint or cancellation of the reservation. Additional fees (in particular a service fee expressed as a percentage of the total ticket price for the event, or fees set by the Event Organizer) may be added to the ticket price for individual events. The Client will be informed of the amount of these additional fees and the total purchase price before purchasing a ticket for the event.

3.3. Promotional discount codes

Discount codes with a specific value are available in the Karabas.ch ticket system. Discount codes reduce the price of each ticket or the price of the entire order by the amount of the discount they represent. Depending on the specific event or event to which the discount code applies, a maximum number of tickets to which discount codes can be applied is specified. Discount codes can be valid for the entire sales period or only on certain days. They can be applied to a group of events or to a single event. Codes are a combination of letters or letters and numbers. The event organizer always decides on the application and conditions of validity of discount codes. Discount codes can be published by any means of communication, including media, social networks, newsletters, on the website www.karabas.ch or via the Organizer (both for everyone and for a selected group of recipients).

3.4. Karabas.ch Vouchers

The Karabas.ch website also offers Vouchers, which can then be exchanged for an event of your choice from those listed on our website.

4. TICKET DELIVERY AND COLLECTION

4.1. General Terms

The following delivery and collection options are available for tickets sold through the Karabas.ch sales system: home delivery, domestic courier delivery and domestic postal delivery. Not all of the above ticket collection and delivery options may be available for a specific event. Customers will be informed of the available ticket collection and delivery options, as well as the delivery costs, no later than at the time of booking.

4.2. Home Ticket

When booking with the "Home Ticket" option, after payment the buyer receives an electronic ticket that can be printed out by the person making the booking. One home ticket entitles one person to attend the event. Karabas.ch is not responsible for the consequences of unauthorized copying of the home ticket received by the person making the booking or by third parties to whom the person making the booking has provided the ticket data.

Home delivery (including printouts or electronic copies). Karabas.ch is not responsible for the consequences of the Client providing an incorrect e-mail address when booking, to which "home tickets" are sent.

4.3. Postal and courier delivery

Tickets are sent in the order of events (tickets for upcoming events are sent first). The maximum delivery period for tickets is 30 days for tickets for events taking place in the Republic of Poland and 60 days for tickets purchased by the Client outside the Republic of Poland (provided that the Client provides a valid delivery address). If the Customer has provided an incomplete or incorrect delivery address, delivery may take longer or may not be made due to the Customer's fault. Please ensure that the information you provide is accurate and complete and fill in the appropriate fields of the form. If you have any doubts about the accuracy of your information, please contact us by phone or via the contact form. Karabas.ch is not responsible for incorrect delivery addresses provided by the Customer. Information on delivery costs is provided when booking tickets.

5. PAYMENT METHODS AND TERMS

5.1. General terms

Depending on the sales channel and the Event Organizer's decision, the following payment methods are available: online transfer, traditional transfer, payment card, BLIK, TWINT, e-wallets, cash, deferred payment and installment plan. Using these payment methods will require concluding a separate agreement with the payment system. When paying for purchases at other points of sale, payment is made in accordance with the rules in effect at these points of sale.

5.2. Payment card

When paying by card after confirming a reservation through the electronic ticket service (by clicking on the "Confirm and pay" field), the Client will be redirected to the payment system's website. Before entering the payment card number, make sure that the redirection is correct, that you are on the payment system's website, and that the connection is encrypted (the website address must begin with "https://"). The payment system is responsible for the processing and security of payment card transactions made on the payment system website, in accordance with the terms and conditions of the payment system. When paying by card, select the card type (the following card types are accepted: Visa, Visa Electron, MasterCard, Maestro, MasterCard Electronic), enter the 16-digit card number, card expiration date and the CVV2/CVC2 code indicated on the back of the card. In the event of cancellation of a ticket reservation through the Karabas.ch sales system due to payment after the expiration of the 15-minute period set by the payment system, Karabas.ch shall not be liable to the Client for the impossibility of purchasing tickets at the originally selected price (in particular, if tickets for the event are sold out, the ticket price has increased or only more expensive tickets are left on Karabas.ch).

5.3. Traditional bank transfer

If you have chosen to pay by traditional bank transfer, payment must be made as soon as possible. Payment must be made in accordance with the instructions in the booking confirmation. The transfer amount must correspond to the amount stated in the booking confirmation; in particular, it must not be rounded up or divided into several transfers. The transfer number must match the number stated in the booking confirmation. It will take 72 hours from the time of booking for the funds to be credited to your Karabas.ch account. After this time, the booking will be cancelled and the tickets will be returned to the general list of tickets available for sale. A cancelled order cannot be restored; only a new order can be placed. In this case, Karabas.ch cannot guarantee the availability of the selected tickets. If payment is received after the above deadline, the Customer will only be entitled to a refund.

6. INVOICE

After selecting the "Invoice with VAT" option in the ticket booking form, the invoice will be sent to the Client in accordance with the terms and conditions specified in the Value Added Tax (VAT) Act. In case of full payment for the ticket, the invoice with VAT will be issued to the Client no later than the 15th (fifteenth) day of the month following the month in which Karabas.ch received the payment.

The invoice with VAT is sent in PDF format to the e-mail address specified by the Client when booking. You can also order an invoice by writing an e-mail to [email protected] indicating the booking number, the amount and the details of the company to which the invoice should be issued.

7. ENTRY AND PARTICIPATION

The Organiser and the owner or manager of the venue where the event is held have the right to refuse entry to visitors who breach any of the terms and conditions of the event or the conditions imposed by them. The Organiser and the owner or manager of the venue where the event is held may conduct security checks from time to time to ensure the safety of visitors.

In the event of late arrivals, the Organiser and the owner or manager of the venue where the event is held will endeavour to ensure entry during a break in the event, although this cannot always be guaranteed.

Unauthorised use of photographic or video equipment is prohibited. Laser pens, mobile phones, dogs (except guide dogs for people with disabilities) and visitors’ own food and drink may also be prohibited (see venue rules and the Organiser’s terms and conditions). Prolonged exposure to noise may damage hearing. The Customer must familiarise themselves with these Terms and Conditions and the details of the specific event before purchasing Tickets. During some events, special effects such as sound, audiovisual, light and pyrotechnics may be used, which may pose a health risk to some people. Customers are required to familiarize themselves with the recommendations of the organizers of cultural and entertainment events during the SARS-CoV-2 epidemic and comply with the rules established by the organizer.

8. TICKET RETURN/REFUND

8.1. Right of Refund

In the event that the Client purchases tickets by concluding an agreement through the Karabas.ch ticket sales system remotely, in accordance with Article of the Consumer Rights Act, the Client does not have the right to terminate the agreement without giving a reason. In the event of purchasing Products, the Client has the right to terminate the agreement within 14 days of receiving the tickets by notifying Karabas.ch of this at [email protected]. The Client is obliged to return the Products immediately.

In the event of termination of the agreement, karabas.ch undertakes to refund the Client the amount paid for the ticket. Only the face value of the ticket is refundable; service fees and additional payments related to the purchase of the ticket are not refundable. The refund will be made no later than 14 days from the date of receipt of the return notice. Karabas.ch has the right to withhold the refund until the receipt of the Products or until confirmation of the return is provided, whichever comes first. The refund will be made using the same payment method used by the Client.

8.2. Refunds

If the Organizer's Terms and Conditions for a specific event provide for the return of tickets, and to the extent such a refund is provided, the following rules apply to Karabas.ch's participation in the refund procedure:

In the event of a ticket refund, Karabas.ch is obliged to refund the Client the ticket price (service fee and additional payments related to the purchase of the ticket are non-refundable) within the framework of the event and in the amount of the amounts received by Karabas.ch from the Organizer for this purpose.

If Karabas.ch receives reliable information from the Organizer about the cancellation of the event or a change in its date or time, Karabas.ch will take the necessary steps to inform Clients as soon as possible.

8.2.1. Refunds in case of event cancellation

In the event of event cancellation, Karabas.ch will refund the ticket price (service fee and additional payments related to the purchase of the ticket are non-refundable) paid at the time of its purchase. In case of payment by card, the funds will be refunded to the card from which the ticket was paid.

Refunds for purchased tickets are made within 14 days from the date of cancellation of the event.

If tickets were purchased at the box office, they must be returned to the place of purchase upon presentation of the receipt.

8.2.2. Refunds in case of change of date or venue

In case of change of date of the event, the Organizer via Karabas.ch will offer the Clients seats at the selected event on another date (subject to availability) at a price equivalent to the cost of the originally purchased tickets. To request a refund for a ticket, please send an email to [email protected], indicating your wish to return the ticket and the booking number. If the date or venue of the event is changed and the Client requests a refund, Karabas.ch will refund the cost of the ticket (service fee and additional payments related to the purchase of the ticket are non-refundable).

In case of payment by bank transfer, the funds will be returned to the bank account number from which the ticket was paid, unless the Client specifies a different account number by sending an email to [email protected] from the email address linked to the order. In case of payment by card, it is necessary to indicate the card payment details in the registration form. The funds will be returned to the card account from which the ticket was paid.

Refunds for purchased tickets are made within 14 days from the moment Karabas.ch receives notification of the intention to return the ticket.

When purchased at a stationary point, the ticket must be returned to the place of purchase upon presentation of the receipt.

8.2.3. Other types of refunds

Tickets cannot be returned or exchanged in cases not specified in paragraphs 8.2.1 and 8.2.2 above.

9. COMPLAINTS

Complaints related to the purchase of a ticket or product in the ticket distribution system can be submitted electronically to [email protected].

Karabas.ch undertakes to respond to complaints promptly, no later than 14 days from the date of receipt.

Karabas.ch is not the Organizer of the events for which it sells tickets. Therefore, the provisions of Section 8 of these Terms and Conditions apply to complaints regarding the return of tickets and reservations.

10. LIABILITY

Karabas.ch is responsible for tickets purchased exclusively through the Karabas.ch website and at partner stationary points of sale. Tickets purchased from other Clients, at unofficial points of sale or from third parties not authorized to sell and distribute tickets may be invalid.

Services ordered by the Client independently, including travel, hotel and accommodation services in connection with the event, are provided by the Client at his own risk.

The Organizer is responsible for the event it organizes, including its conduct and progress, as well as for admitting the Client to participate.

11. PERSONAL DATA

Personal data provided by Clients in specially designated areas is processed by Karabas.ch in accordance with applicable law and the Privacy Policy.

The Client's personal data is transferred to the Organizers only in cases specified in the Terms and Conditions for the execution of Transactions and the organization of events. In other cases, this is permitted only with the prior consent of the data subject.

The information specified in this section cannot be used for commercial purposes related to the promotion of the Client's activities carried out outside of Karabas.ch in any form.

The Company reserves the right to filter and save messages sent by Clients using the tools provided on the Karabas.ch website, in particular if they are spam, contain content that violates these Terms and Conditions, or otherwise threaten the security of the Client.

If, as a result of the above-mentioned automatic analysis of messages, the Company is unable to respond to the Client, his message will be immediately transferred to the Organizer for a response.

12. TERMINATION AND CHANGES TO TERMS

The Client may terminate their legal relationship with Karabas.ch immediately by deleting the account they have created. Termination shall not affect the mutual obligations of Karabas.ch and the Client arising from a previously purchased ticket, Product or Voucher.

These Terms may be amended in accordance with the terms and to the extent specified in these Terms.

A change to the Rules shall enter into force within 14 days from the date of receipt of notice of the change or within another period specified in such notice, except in cases where the Client terminates their legal relationship with Karabas.ch before the changes enter into force in the manner and with the consequences specified above. A change to the Rules shall not apply to purchases of tickets, Products or Vouchers made prior to the changes, to which the Rules in the version in effect on the date of purchase shall apply.
